Firm Wins Dismissal of Lawsuit Arising from Alleged Radiation Exposure

On December 19, 2008, Judge John Gleeson of the Eastern District of New York granted a motion to dismiss submitted by Schoeman, Updike & Kaufman, LLP on behalf of its clients, Entergy Nuclear Indian Point 3, LLC, Entergy Nuclear Indian Point 2, LLC, General Electric Company, Westinghouse Electric Corporation, Consolidated Edison, Inc., New York Power Authority, and Wayne Leonard. 

The complaint alleged that the plaintiff suffered injuries as a result of exposure to radiation originating from the Indian Point Energy Center.  The court granted the motion to dismiss because the complaint failed to state a claim and was time-barred.
