Gayle A. Stein, Counsel
Gayle A. Stein concentrates her practice in employment, human resources and labor law. She has represented public and private employers regarding federal, state and local employment and labor law issues. Her practice encompasses litigation, arbitrations, and administrative proceedings in the areas of employment discrimination, labor law, employment agreements/restrictive covenants and related tort litigation. She counsels on a broad range of employment and labor law issues.
In litigation, she has successfully represented a public university in a Title VII action; a national restaurant and entertainment complex in multiple race discrimination claims; large public and private corporations in disputes over restrictive covenants, non-competition agreements, charges of unfair labor practices, unemployment compensation and other claims in various procedural postures before state and federal agencies and state and federal courts. She has counseled hospitals, nursing homes, large manufacturers, small businesses, a public university, banking institutions, restaurants and other corporate clients, on hiring, firing, FMLA, ADA, FLSA, affirmative action plans and audits, and other labor and employment law issues; prepared employment and consultant agreements, including trade secrets/noncompetition provisions; prepared employee manuals and detailed advice letters covering various employment and labor-related topics, including FMLA, ADA, FLSA, sexual harassment, discrimination, at-will employment, substance abuse, privacy, electronic communications and solicitation and distribution. She has also participated in training managers, supervisors and employees in ADA, FMLA, sexual harassment, union avoidance, workplace violence, and other labor and employment topics.
Ms. Stein received her J.D. degree from Temple University James E. Beasley School of Law in 1994 (Distinguished Class Performance, Legal Research and Writing; I. Herman Stern Moot Court Competition 1992, participant; Barrister’s Society Client Counseling Competition 1992, participant) and her B.A. from The George Washington University, cum laude in 1991 (Dean’s List; Golden Key National Honor Society, member; Omicron Delta Kappa Honor Society, member; Order of Omega Honor Society, President).

Representative Matters:
EEO and Civil Rights Litigation:
- Represented public university in Title VII action brought by University’s former in-house counsel, resulting in summary judgment in favor of the client.
- Represented national restaurant and entertainment complex in two Section 1981 matters, each involving multiple race discrimination claims, resulting in summary judgment for the client in each case.
- Represented employee in federal court action involving California state law claim for wrongful discharge and Title VII claim for sexual harassment.
- Represented national bank in non-competition lawsuit; client prevailed after bench trial.
- Represented smoked fish distributor in action for preliminary and permanent injunctive relief against former employee, for breach of restrictive covenants in employment agreement, in U.S. District Court for the Eastern District of Pennsylvania.
- Represented silicate products manufacturer in action involving alleged breach of restrictive covenant and trade secret agreement.
Labor and Employment Arbitrations and Administrative Matters:
- Represented manufacturer of silicate products in a variety of labor-related matters, including unfair labor practice charges and arbitrations.
- Successfully represented food products manufacturer in alleged unpaid bonus matter before Illinois Department of Labor, Wage and Hour Division. Represented the same client in another Wage and Hour matter alleging violation of One Day Rest In Seven Act.
- Represented employers in discrimination cases before state administrative agencies and the federal Equal Employment Opportunity Commission.
- Represented employers regarding payment of unemployment compensation before Pennsylvania and Illinois unemployment compensation agencies.
Counseling:
- Counseled hospitals, nursing homes, large manufacturers, small businesses, a public university, banking institutions, restaurants and other corporate clients, on hiring, firing, FMLA, ADA, FLSA, and other labor and employment law issues.
- Prepared employment and consultant agreements, including trade secrets/noncompetition provisions.
- Involved in policy development and preparation of employee manuals and detailed advice letters covering various employment and labor-related topics, including but not limited to FMLA, ADA, FLSA, sexual harassment, discrimination, at-will employment, substance abuse, privacy, electronic communications and solicitation and distribution.
- Addressed employment issues in corporate transactions.
- Involved in preparation of reduction in workforce programs.
- Trained managers, supervisors and employees in ADA, FMLA, sexual harassment, union avoidance, workplace violence, and other labor and employment topics.
- Represented children’s residential home and treatment facility in union organizing campaign, and prevailed in election.
- Counseled employers on wage and hour issues.
- Counseled employers on affirmative action plans and audits.
- Involved in collective bargaining on behalf of municipality with unions representing the municipality’s police and fire fighters.
- Restructured management of employee personnel files and confidential medical files at several plants of international food products manufacturer and advised client on various employment/human relations matters.
