John O. Delamater, Counsel
John O. Delamater is in the firm's New York office, where as a member of the Personal Services Practice, he concentrates in estate and trust administration, including related property transactions, adversary proceedings and taxation issues. Among other things, Mr. Delamater provides drafting of wills, advance directive documents and trusts for various purposes. His practice includes planning for the continuity of businesses; use of family limited liability companies; succession planning; and general estate planning. His experience in adversary proceedings includes, among other things, discovery proceedings, turn-over proceedings, contested trust documents and will contests.
Representative Matters:
Retained by residuary legatee to represent her interests in a contested Probate Proceeding, where a natural heir of the decedent filed Objections to the validity of the Will in Surrogates Court, Kings County. Discovery completed; decision on motion for summary judgment denied, but successfully resolved and will allowed to probate after appeal to Appellate Division, Second Department.
