Firm Represents PLAC in Wisconsin Supreme Court

The Firm recently filed two amicus briefs in the Wisconsin Supreme Court on behalf of the Product Liability Advisory Counsel. In Godoy v. E.I. DuPont De Nemours, et. al., which involved allegations against a lead paint pigment, PLAC supported the defendant’s position that a product with inherent risks cannot be subject to design defect claims and to do so would deprive the public of hundreds of necessary and desirable everyday products. The PLAC brief was filed on July 1. In the second case, Blunt v. Medtronic, which involved allegations against a Class III medical device, PLAC urged the court to affirm the preemption defense because the allegations did not constitute exempted parallel claims and because of the benefits to public health. The PLAC brief was filed on July 11, 2008.
