Firm Obtains Dismissal of Complaint Against Its Client GlaxoSmithKline for Failure to State a Cause of Action

Partners Michael Schoeman, Beth Kaufman, and David Gordon and Associate Maureen Godfrey successfully defended SmithKline Beecham Corporation d/b/a GlaxoSmithKline ("GSK") against claims by a former employee that it violated the Employment Retirement Income Security Act ("ERISA"), the former employee's civil rights under 42 U.S.C. Section 1983 and various related state law torts.

On November 28, 2006, plaintiff filed her complaint in the United States District Court for the Northern District of New York. On September 5, 2007, in a thoroughly reasoned, 19 page decision Judge McCurn granted GSK's motion to dismiss for failure to state a cause of action and dismissed all claims against GSK.
