Firm Wins in Iowa Appeal for Client Pharmacia

The Iowa Court of Appeals, in a decision issued on February 13, 2008, affirmed summary judgment in favor of the Firm's client, Pharmacia Corporation. The judgment resolved a dispute with Fisher Controls International, Inc. over which corporation had the responsibility for thousands of personal injury claims that arose out of business operations from over 40 years ago. The dispute turned on construction of an agreement transferring the assets and liabilities of Fisher Controls' predecessor company. The appellate court concluded that the language of the transfer agreement and the circumstances of its formation fully supported summary judgment for Pharmacia. Partner Stephanie Scharf represented Pharmacia in the trial court and Ms. Scharf and counsel Mary Ann Becker represented Pharmacia on appeal, along with co-defense counsel Mark McCormick from Belin Lamson McCormick Zumbach Flynn.
