Scharf Writes for FDLI on Issue of Punitive Damages
Partner Stephanie Scharf has published an article for the May/June issue of Update, the journal of the Food and Drug Law Institute, entitled, “Punitive Damages in the Supreme Court: How Much is Too Much?” After reviewing the history of U.S. Supreme Court decisions over the past decade on this subject, Scharf identifies two conflicting views that have emerged from the Court’s decisions, and explains why the Court’s jurisprudence is likely to lead to a dilemma for constitutional limits on punitive awards.
