Nancy Connery's Article on Tenant Buyouts Published
Partner Nancy Connery has published an article in the N.Y. Real Property Law Journal (Winter 2008 issue; Vol. 36, No. 1) on the topic of commercial tenant buyouts. In the article, she discusses the various issues that arise when a landlord seeks to buy out commercial tenants' lease rights. Buyouts typically occur when a building owner seeks to recapture space for its own use, to demolish a building, to lease space to a "credit" tenant, or to convert space to another use. The issues covered by Ms. Connery include confidentiality agreements, transfer taxes, appropriate termination language, and timing issues.
