Defense Against Product Liability Claims

Product liability defense demands lawyers who clearly understand the legal and scientific issues at hand. We have defended clients in some of the largest product liability cases in the nation and have taken on many roles in the defense of these claims. We have served as National Coordinating Counsel, Regional Counsel, Trial Counsel, and on Defendant Steering Committees. We have also served in unique roles such as Science Counsel, Regional Counsel and Discovery Counsel.

We take on class action lawsuits and toxic tort claims involving everything from consumer products to industrial equipment, including chemicals, pharmaceutical products, medical devices, automobiles, swimming pools, industrial gases and equipment, and asbestos-containing products. Representative cases include:

  • National Coordinating Counsel for hundreds of individual lawsuits and class actions across the United States in claims involving serious neurological and rheumatologic illnesses allegedly caused by vaccine use. We successfully resolved these claims through an agreement to arbitrate claims.
  • National Science Counsel for mass tort defense charged with developing scientific and medical defenses, and coordinating the courtroom presentation of all scientific evidence in the fields of neurology, infectious diseases and epidemiology.
  • Obtaining summary judgment for a company that owns nuclear reactors in two radiographic exposure cases in which the plaintiff sought damages for cancer allegedly caused by exposure to radiation.

In addition, we are well-situated to assist clients in assessing product risks and managing litigation risks. We frequently work with clients to assess scientific, technical, regulatory, marketing and sales activities and provide actionable, effective recommendations for minimizing exposure. We also collaborate with our clients’ marketing and business personnel to develop cohesive media strategies as necessary.
